Born April 1, 1819 in North Carolina; died January 22, 1882 in Russell County, Kentucky.

His son, Patrick Luther Patterson, joined the side of the Union forces. He enlisted November 7, 1862 as a Private, Company D, 32nd Regiment, Kentucky Volunteer Infantry, USA; also again September 28, 1863 as a Private in Company F, 13th Regiment, Kentucky Cavalry, USA. Born August 1, 1846 in Lumpkin County, Georgia; died January 11, 1925 in Russell County, Kentucky.

Philips, A. J. (or Phillips) - Private in Infantry Battalion, Smith's Legion, Georgia Volunteers, August 25, 1862. Transferred to Co. E, 65th Regiment Georgia Infantry, March 1863. Deserted at Loudon, Tennessee, April 3, 1863.

Philips, James P. (or Phillips) - Private in Inf. Battalion., Smith's Legion, Ga. Vols., Feb. 17, 1863. Transferred to Co. E, 65th Regiment, Georgia Infantry, March 1863. Sick in hospital August 31, 1864. Deserted to the enemy April 3, 1865. Took oath of allegiance to U.S. Government, April 8, 1865, and decided to remain north of the Ohio River for the remainder of the war.

Walker, Henry - Private. Name appears only on roll of men paroled at Greensboro, N. C., Apr. or May 1865, which states that he enlisted Mar. 20, 1862.

Editor note: "Family story has it that Thomas, along with John Young, Co E, 65th GA and Benjamin Allison, Co E, 65th GA, deserted from Kingston, TN on June 12, 1863. John Young, being a good swimmer, swam the Tennessee River; stole a paddle boat; then went back for Thomas and Benjamin. The three men hid from their unit until nightfall, when they began walking. Once far enough away from their unit, they also walked during the day. When he got home to Fannin County, Georgia, Thomas slept in a hollow log near his home. His wife, Elizabeth, would sneak food to him. Later, he walked through the mountains to Athens, Tennessee, and joined the Union Army for 1 year. His Union Army assignment: Company E, 7th Regiment, Tennessee Mounted Infantry. Thomas was honorably discharged July 27, 1865 at Nashville, TN. I (Beth Watson) cannot confirm the part of the story about John swimming the Tennessee, but the rest is true to the best of my knowledge." Yother, Marion (or Yeather) - Private in Infantry Battalion., Smith's Legion, Georgia Volunteers, Aug. 28, 1862. Transferred to Company E, 65th Regiment Georgia Infantry, March 1863. Deserted June 29, 1863. Rejoined company and court marshaled. Deserted July 2, 1864, near Kennesaw Mountain, Georgia. Captured near Marietta, Georgia, July 3, 1864, and sent to Camp Douglas, Illinois, (prison). Released June 16, 1865.

Yother, Traverse J. (or Yeather) - Private in Infantry Battalion, Smith's Legion, Georgia Volunteers, August 28, 1862. Transferred to Co. E, 65th Regiment Georgia Infantry, March 1863. Deserted on march from Tennessee, September 7, 1863. Rejoined company and was court marshaled March or April 1864. Captured at Nashville, Tennessee, December 16, 1864, and sent to Camp Chase, Ohio (prison). Died there of pneumonia, February 3rd or 5th of 1865. Buried in Grave No. 318, Camp Chase Confederate Cemetery.

Young, J. W. - Private in Infantry Battalion, Smith's Legion, Georgia Volunteers, August 28, 1862. Transferred to Company E, 65th Regiment, Georgia Infantry, March 1863. Deserted at Kingston, Tennessee, June 12, 1863. No later record. (see Thomas Watson, above)

Of the 92 men listed in this muster roll, 51 deserted at some time. Many of these men were either apprehended and court-martialed or captured and imprisoned by the enemy; several saw all of the above.
